The Innuendo is a tabloid newspaper. It published a story about Smokey Fire, a famous rock singer, that alleged that Smokey had cheated two different people out of money. The story was totally false, but The Innuendo had no knowledge that its sources were lying, as these sources appeared to be reputable. Smokey has sued The Innuendo. Please name and define the legal theory Smokey is most likely to use. Answer: smokey will sue them for defamation of character. Defamation is the oral or written publication of a false statement about someone, that unjustly harms the person's reputation and usually constitutes a tort or crime. The innuendo has published a statement about smokey, which has been verified to be a false statement, even though it was not published intentionally to hurt smokey, because their never knew the statement was false, the court will still have to charge them for defamation, and their owe smokey another publication, which will contradict their previous false publication. The source they got their statement will be only invited to the case if only the innuendo wants to sue them along with the case. Every statement is meant to be verified before publication, so the innuendo has to verify the story their got from the source before publication. Smokey won't sue the source because it has not publicise any false story. The innuendo can sue the source for false information and deceit.
